Every person will be required to obtain a land disturbance or grading permit from the Public Works Director or designee in the following cases:
Land disturbing or grading activity generally affecting one or more acres of land;
Land disturbing or grading activity affecting less than one acre of land if the activity is part of a larger common plan of development affecting one or more acre of land;
Land disturbing or grading activity affecting less than one acre of land, if in the discretion of the Public Works Director or designee such activity poses a unique threat to water quality or public health or safety;
The creation and use of borrow pits; or
Processing earthen materials such as top soil and gravel screening.
